Terms and Conditions - Saranda Boat 1
1. Acceptance of Terms:
By booking a tour with Saranda Boat 1 (hereinafter referred to as "the Company"), you (hereinafter referred to as "the Customer") acknowledge and agree to be bound by these Terms and Conditions. These Terms and Conditions constitute the entire agreement between the Customer and the Company.
2. Booking and Payment:
- 2.1 Booking: Bookings can be made online, by phone, or in person. A booking is confirmed upon receipt of a deposit or full payment, as specified by the Company.
- 2.2 Payment: Full payment is required 1 day prior to the tour departure, unless otherwise agreed upon. Payment methods accepted are cash or Paypal.
- 2.3 Pricing: Prices are subject to change without notice. The Company reserves the right to adjust prices due to unforeseen circumstances, such as fuel price increases or changes in government regulations.
- 2.4 Late Bookings: Bookings made within 1 day of the tour departure may require immediate full payment.
3. Cancellations and Refunds:
- 3.1 Customer Cancellations:
- Cancellations made 2 days or more before the tour departure will receive a full refund, less the deposit.
- Cancellations made within 1 day of the tour departure are non-refundable.
- No-shows will not be refunded.
- 3.2 Company Cancellations:
- The Company reserves the right to cancel or modify tours due to weather conditions, mechanical issues, or other unforeseen circumstances.
- If the Company cancels a tour, the Customer will be offered a full refund or the option to reschedule.
- 3.3 Refund Processing: Refunds will be processed within 15 business days of the cancellation.
4. Tour Details and Responsibilities:
- 4.1 Itinerary: The Company reserves the right to modify the tour itinerary due to weather, safety concerns, or other unforeseen circumstances.
- 4.2 Safety: The Customer is responsible for adhering to all safety instructions provided by the Company’s crew.
- 4.3 Conduct: The Customer agrees to conduct themselves in a respectful and responsible manner towards other passengers and the crew.
- 4.4 Personal Belongings: The Company is not responsible for any loss or damage to the Customer’s personal belongings.
- 4.5 Health and Fitness: The Customer is responsible for assessing their own health and fitness level and ensuring they are capable of participating in the tour. Customers with pre-existing medical conditions should consult their doctor before booking.
- 4.6 Children: Children must be supervised by a responsible adult at all times. Life jackets must be worn by children at all times when instructed by the crew.
- 4.7 Alcohol and Drugs: The Company reserves the right to refuse service to any Customer who appears to be under the influence of drugs. Consumption of illegal drugs is strictly prohibited.
5. Liability and Insurance:
- 5.1 Limitation of Liability: The Company’s liability is limited to the amount paid by the Customer for the tour.
- 5.2 Exclusions: The Company is not liable for any indirect, consequential, or incidental damages.
- 5.3 Personal Insurance: The Customer is responsible for obtaining their own travel insurance, including medical and personal liability coverage.
- 5.4 Force Majeure: The Company is not liable for any delays or cancellations caused by events beyond its control, including but not limited to natural disasters, acts of terrorism, or government regulations.
6. Weather Conditions:
- 6.1 Weather Policy: Tours are subject to weather conditions. The Company will make every effort to operate tours as scheduled, but safety is our priority.
- 6.2 Rescheduling: If a tour is canceled due to weather, the Customer will be offered the option to reschedule or receive a refund as per the cancellation policy.
7. Photography and Media:
- 7.1 Consent: The Customer consents to the Company using any photographs or videos taken during the tour for promotional purposes, unless they explicitly state otherwise in writing.
8. Disputes and Governing Law:
- 8.1 Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of Albania.
- 8.2 Dispute Resolution: Any disputes arising from these Terms and Conditions shall be resolved through mediation in Sarande, Albania.
9. Amendments:
- 9.1 Changes: The Company reserves the right to amend these Terms and Conditions at any time without prior notice. Any changes will be posted on the Company’s website.
